The Party Wall etc. Act 1996

We provide specialist Party Wall services for both Building Owners and Adjoining Owners in connection with works covered by the Party Wall etc. Act 1996. The Party Wall Act exists to prevent and resolve disputes between neighbours where building works may affect shared walls, boundary walls, or excavations close to adjoining property. Even where relationships are amicable, following the correct legal procedure is essential to avoid misunderstandings, delays, or costly disputes later on.

Serving accurate and timely Party Wall Notices is a critical first step in the process. These formal notifications ensure that all affected parties are properly informed of the intended works and have the opportunity to respond within the statutory timeframe. Failure to serve the correct notices, or serving them incorrectly, can lead to objections, project delays, or even enforcement action.

Where works fall within the scope of the Act, the preparation of a formal Party Wall Award before works commence is equally important. The Award sets out the rights and responsibilities of all parties, records the condition of adjoining property, and establishes how the works are to be carried out. This provides vital protection for both the Building Owner and Adjoining Owner should any issues or damage arise during or after construction.
